LYRICRAFT STUDIOS CUSTOMER TERMS OF USE

These Terms of Use govern your use of LyricraftStudios.com and your purchase or use of services offered by Lyricraft Studios, LLC.

By accessing this website, creating an account, placing an order, purchasing a custom song, or otherwise using our services, you agree to these Terms of Use, our Privacy Policy, and any other policies referenced on our website.

If you do not agree to these Terms, please do not use the website or purchase our services.

1. ABOUT LYRICRAFT STUDIOS

Lyricraft Studios, LLC (“Lyricraft Studios,” “we,” “us,” or “our”) provides custom song creation services.

Customers provide stories, memories, names, preferences, musical direction, and other information that we use to create personalized songs specifically for them.

Our website is located at LyricraftStudios.com and includes any pages, subdomains, customer accounts, ordering systems, and related services operated by Lyricraft Studios.

2. ELIGIBILITY

You must be legally capable of entering into a binding agreement to purchase services from Lyricraft Studios.

If you place an order on behalf of another individual, organization, or entity, you represent that you have authority to do so and to provide any materials submitted in connection with the order.

3. CUSTOMER ACCOUNTS

You may be able to place an order without creating an account.

If you create an account, you are responsible for providing accurate information and maintaining the security of your login credentials.

You are responsible for activity that occurs through your account.

Lyricraft Studios may suspend, restrict, or terminate an account if we reasonably believe the account has been misused, compromised, or used in violation of these Terms.

4. PLACING AN ORDER

When placing an order, you will select a song package and provide information that may include:

  • the person or occasion the song is about;
  • personal stories, memories, names, sayings, jokes, or other details;
  • preferred musical genre, mood, vocal style, or creative direction;
  • desired delivery timing;
  • lyrics, poems, letters, or other materials you would like us to consider; and
  • any other information requested during the ordering process.

You are responsible for reviewing the information you provide for accuracy.

Lyricraft Studios is not responsible for errors resulting from incorrect names, dates, spellings, pronunciation guidance, story details, or other information supplied by the customer.

5. PAYMENT

Payment is required before Lyricraft Studios begins creating your custom song unless we specifically agree to another arrangement in writing.

Prices are displayed at checkout and may vary depending on the package, optional services, discounts, promotions, rush delivery, or other selected features.

Payment processing may be provided through third-party payment processors. Those providers may have their own terms, privacy policies, authentication requirements, and payment procedures.

6. CUSTOM SONG PRODUCTION PROCESS

After your order and payment are received, Lyricraft Studios begins reviewing the information you provided and developing the creative direction for your song.

Your project generally follows this sequence:

Order and payment → Initial preview → Direction approval → Full production → Finished song → Included revisions

The initial preview stage is designed to establish the creative direction of the project before the full song is produced.

7. INITIAL PREVIEWS

Initial previews are short creative-direction samples, typically approximately 30 seconds in length.

Depending on the package you select, your purchase may include one or more initial previews.

Initial previews are intended to help establish elements such as:

  • musical style;
  • vocal approach;
  • pacing;
  • mood;
  • lyrical direction; and
  • overall creative feel.

An initial preview is not intended to represent a continuing series of partial-song updates throughout production.

Once you approve an initial direction, Lyricraft Studios will proceed with full production of your song.

Additional initial previews beyond those included with your package may be available for an additional fee.

8. CUSTOMER APPROVAL AND RESPONSE TIMES

Your timely feedback is an important part of the custom-song process.

If Lyricraft Studios is waiting for your approval, clarification, additional information, pronunciation guidance, or another response necessary to continue production, the production timeline may be paused until we receive that information.

Any delivery estimate may be extended by customer delays.

A previously discussed or requested delivery date cannot be guaranteed if required customer feedback or approval is not received in sufficient time to complete the project.

9. DELIVERY TIMEFRAMES

Estimated production times displayed on our website are estimates based on normal production conditions.

Unless otherwise stated, production timelines are calculated using business days.

Business days do not include Saturdays, Sundays, or federally observed United States holidays.

The timeframe for completing the full song begins after you approve the initial creative direction and provide any information reasonably required for production to continue.

Lyricraft Studios will make reasonable efforts to meet stated delivery estimates, but delivery times may be affected by project complexity, revision requests, customer delays, technical issues, unusual demand, or circumstances outside our reasonable control.

10. RUSH DELIVERY

Rush Delivery may be offered for certain orders for an additional fee.

Rush Delivery is subject to current production capacity and availability.

Purchasing Rush Delivery does not eliminate the requirement for customer approval of the initial preview.

Any Rush Delivery timeframe begins after the required initial preview has been approved unless Lyricraft Studios agrees otherwise in writing.

Rush availability, pricing, and estimated turnaround times may change.

11. REVISIONS

Song packages may include a specific number of revision rounds.

Revision rounds take place after the completed song has been delivered unless otherwise agreed.

A revision round allows you to submit a group of requested changes for us to review and implement where reasonably possible.

Revision requests may include adjustments such as:

  • lyrics;
  • wording;
  • pronunciation;
  • pacing;
  • certain arrangement details; or
  • other reasonable refinements within the approved creative direction.

A revision request does not automatically include creating an entirely new song or replacing the previously approved creative direction.

Requests that substantially change the approved genre, concept, structure, story, vocal direction, or overall creative approach may require additional fees.

Additional revision rounds beyond those included with your package may also require an additional fee.

12. CUSTOMER-SUPPLIED LYRICS AND MATERIALS

You may submit your own lyrics, poems, letters, stories, photographs, written material, or other content for use in your project.

By submitting material to Lyricraft Studios, you represent that:

  1. you created the material yourself; or
  2. you have the necessary permission or rights to provide it to us and authorize its use in connection with your project.

You grant Lyricraft Studios permission to use, edit, adapt, arrange, and incorporate submitted materials as reasonably necessary to provide the services you purchased.

Unless you instruct us otherwise, we may make reasonable adjustments to customer-supplied lyrics or writing for musicality, rhythm, phrasing, rhyme, structure, or song length.

13. CONTENT RESTRICTIONS

Lyricraft Studios welcomes a wide range of personal stories, emotions, humor, celebrations, and creative ideas.

We reserve the right to decline, suspend, or cancel projects involving content that we determine is unlawful, threatening, hateful, exploitative, fraudulent, abusive, or otherwise inappropriate for our service.

If you are unsure whether a particular concept is appropriate, please contact us before placing your order.

14. USE OF TECHNOLOGY AND AI-ASSISTED TOOLS

Lyricraft Studios uses a combination of human creative direction and modern music-production technology.

This may include artificial-intelligence-assisted tools used during songwriting, musical arrangement, vocal production, audio production, editing, or other parts of the creative process.

AI-assisted tools are part of our production workflow, but Lyricraft Studios does not simply submit customer information to an automated system and deliver an unreviewed output.

We use the customer’s story, preferences, feedback, and approved direction to guide the creation and development of the finished song.

15. REFUNDS AND CANCELLATIONS

Because every Lyricraft Studios song is created specifically for the customer, all sales are final and all payments are non-refundable once work on the custom song has begun.

Work begins when Lyricraft Studios starts creating the initial preview or otherwise begins custom production for the order.

If you request cancellation before work has begun, Lyricraft Studios may approve cancellation and issue a refund, less any non-refundable payment-processing fees or other costs already incurred.

Once work has begun, cancellation by the customer does not entitle the customer to a refund.

If Lyricraft Studios is unable to complete your project due to an issue on our end, we will determine the appropriate resolution based on the circumstances.

16. ORDER CANCELLATION BY LYRICRAFT STUDIOS

Lyricraft Studios may cancel an order when reasonably necessary, including when:

  • required payment has not been received;
  • a customer stops responding and production cannot reasonably continue;
  • information necessary to complete the project is not provided;
  • the requested delivery date can no longer reasonably be met because of customer delay;
  • submitted content violates these Terms;
  • the project cannot reasonably be completed as requested; or
  • technical, operational, legal, or other circumstances prevent us from completing the order.

If an unpaid order is cancelled, no payment is due.

If a paid order is cancelled by Lyricraft Studios, we will determine the appropriate resolution based on the circumstances and the amount of custom work already completed.

17. PERSONAL USE RIGHTS

Unless separate commercial-use rights are obtained in writing, your purchase includes a personal, non-commercial license to use and enjoy your finished song.

You may:

  • listen to the song;
  • download and store the song;
  • share it privately with friends and family;
  • play it at personal celebrations or gatherings;
  • use it in personal videos or slideshows;
  • give it as a personal gift; and
  • make reasonable edits for your own personal, non-commercial use.

Personal-use rights do not include commercial exploitation of the song.

18. COMMERCIAL USE

A standard Lyricraft Studios purchase does not include commercial-use rights.

You may not use the song for advertising, business promotion, monetized media, commercial distribution, resale, licensing, commercial releases, revenue-generating content, or other commercial purposes without separate written permission from Lyricraft Studios.

Commercial-use rights may be available separately.

If you are interested in commercial use, contact Lyricraft Studios and describe how you intend to use the song.

Commercial licensing terms and pricing may vary depending on the nature and scope of the proposed use.

19. MODIFICATIONS TO THE FINISHED SONG

You may make reasonable modifications for personal, non-commercial purposes, including trimming the song or incorporating it into a personal video or slideshow.

You may not sell, commercially distribute, monetize, sublicense, substantially repurpose, or commercially exploit a modified version without appropriate written permission.

20. INTELLECTUAL PROPERTY

The Lyricraft Studios website, branding, logos, graphics, written content, website design, software, and other materials created for or used on the Site are owned by or licensed to Lyricraft Studios and are protected by applicable intellectual-property laws.

You may not copy, reproduce, distribute, modify, publish, sell, license, or commercially exploit Site content without written permission from Lyricraft Studios.

Rights relating to custom songs are governed by the personal-use and commercial-use provisions of these Terms and any separate written licensing agreement entered into between Lyricraft Studios and the customer.

Nothing in these Terms transfers ownership of the Lyricraft Studios name, branding, website, production systems, or other proprietary business materials to the customer.

21. THIRD-PARTY SERVICES

Our Site and services may rely on third-party providers, including payment processors, hosting providers, email providers, music-production technology, analytics services, and other software or infrastructure.

Lyricraft Studios is not responsible for interruptions, failures, errors, security incidents, or other problems caused solely by third-party services outside our reasonable control.

Your use of certain third-party services may also be subject to their own terms and privacy policies.

22. WEBSITE USE

You agree not to use the Site:

  • for unlawful purposes;
  • to interfere with the Site’s security or operation;
  • to attempt unauthorized access to accounts or systems;
  • to distribute malware or harmful code;
  • to impersonate another person;
  • to submit fraudulent payment information;
  • to violate another person’s intellectual-property or privacy rights; or
  • in any manner that could damage Lyricraft Studios or interfere with another person’s use of the Site.

We may restrict or terminate access to the Site for violations of these Terms.

23. WEBSITE AVAILABILITY

We work to keep LyricraftStudios.com available and functioning properly, but we do not guarantee uninterrupted or error-free access.

The Site may occasionally be unavailable because of maintenance, software updates, hosting issues, third-party outages, security concerns, or other technical circumstances.

24. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Site and services are provided on an “as available” basis.

Because musical taste and emotional response are subjective, Lyricraft Studios cannot guarantee that every customer or recipient will have a particular emotional reaction to a finished song.

We do, however, provide the preview and revision process described in these Terms to give customers meaningful opportunities to guide and refine their project.

25. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Lyricraft Studios will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the use of the Site or services.

This includes, where legally permitted, damages associated with lost profits, lost opportunities, loss of data, business interruption, or similar losses.

To the fullest extent permitted by applicable law, Lyricraft Studios’ total liability arising from a particular order will not exceed the amount actually paid to Lyricraft Studios for that order.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

26. INDEMNIFICATION

You agree to indemnify and hold harmless Lyricraft Studios, its owners, employees, contractors, and service providers from claims, liabilities, losses, or reasonable expenses arising from material you submit to us when such claims result from your violation of these Terms, infringement of another person’s rights, or unauthorized use of material you did not have permission to provide.

27. TERMINATION

Lyricraft Studios may suspend or terminate your access to the Site or your account if you violate these Terms, misuse the service, engage in fraudulent activity, interfere with the Site, or otherwise create a legal, technical, security, or operational risk.

Provisions that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, personal and commercial use rights, limitations of liability, disputes, and payment obligations.

28. CHANGES TO THESE TERMS

We may update these Terms periodically.

When changes are made, the revised Terms will be posted on LyricraftStudios.com with an updated effective date.

Changes will apply prospectively unless applicable law requires otherwise.

Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms.

29. GOVERNING LAW AND DISPUTES

These Terms and any dispute arising from or relating to the Site or Lyricraft Studios services will be governed by the laws of the State of New York, without regard to conflict-of-law principles.

Before filing a formal legal claim, you and Lyricraft Studios agree to make a reasonable good-faith effort to resolve the dispute directly.

Any dispute-resolution procedures, arbitration requirements, venue provisions, or other legal remedies will be applied consistent with applicable law.

30. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

31. NO WAIVER

Failure by Lyricraft Studios to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.

32. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, applicable checkout terms, package descriptions, and any written agreement specifically entered into for your order, constitute the agreement between you and Lyricraft Studios regarding your use of the Site and services.

If a specific written agreement between you and Lyricraft Studios conflicts with these general Terms, the specific written agreement will control for that particular matter.
